    Wendy D. Vierra

    Practice Focus

    Ms. Vierra's experience extends to most aspects of complex civil litigation, including class actions, professional liability, personal injury, product liability, premises liability, defense of consumer rights actions, including litigation involving the Fair Debt Collection Practices Act (FDCPA) and the Fair Credit Reporting Act (FCRA), and appeals. She also provides insurers opinions on a wide variety of first- and third-party coverage issues.

    Ms. Vierra is admitted to practice before the state bars of California,Washington and Oregon, as well as before all federal district courts in California.

    Representative Cases

    Sutton v. A.H.W. (January 2008) Legal Malpractice – defended action along with partner Mark Ellis.  Multi million dollar claims against attorney clients settled for less than cost of defense after motions in limine threatened to gut plaintiff’s claims.

    Liceaga v. Debt Recovery Solutions, LLC (2008) 86 Cal.Rptr.3d 876 (California Supreme Court review denied, but ordered not published)

    Russ v. M.H.A. (March 2007) Legal Malpractice – defended action along with partner Mark Ellis.  Nonsuit and post trial motions eliminated most of plaintiff’s damages against client law firm; case resolved for confidential settlement while on appeal.

    Education

    Ms. Vierra received her B.S. with honors from U.C. Davis, and was a member of the Psi-Chi Honor Society. She earned her J.D. in 2000 from McGeorge School of Law, University of the Pacific, graduating with Great Distinction (Top 5%). Her honors included Order of the Coif, the Traynor Honor Society and Am Jur Legal Research & Writing.
